Website terms.

The plain-English rules for using this website. Project work is covered separately, by a written quote and agreement.

About these terms

These terms apply to your use of headwaterstudios.co.uk (the "site"), which is run by Headwater ("we", "us") in the United Kingdom. By using the site you agree to them. If you don't agree, please don't use it. You can contact us at hello@headwaterstudios.co.uk.

Projects are agreed separately

Nothing on this site is a contract to build anything. The prices, timelines and descriptions here are a general guide. When you ask us to work with you, we'll scope the project and send a written fixed-price quote. Our work only starts once you've accepted it, and it is then governed by the terms in that quote or agreement, not by these website terms.

Using the site

You're welcome to browse the site, try the demos and contact us through it. Please don't:

  • use the site unlawfully, or in a way that harms it or other people;
  • try to break, overload, scan or gain unauthorised access to the site or its systems;
  • use automated tools to scrape the site or to send us spam through the contact form; or
  • pass off our content as your own.

Client stories and demos

Our client stories describe real projects, published with each client's agreement. The interactive demos are illustrations of how those systems work. They use made-up data and don't connect to any client's real system or records. The stories are a snapshot, and a particular result or feature isn't a promise that your project will be the same.

Intellectual property

The site's design, text, code, logo and demos belong to us or our licensors, and are protected by copyright and other rights. You may view the site and share its pages by link. You may not copy, reproduce or reuse the content for other purposes without our written permission. Client names and brands belong to their owners and appear with permission.

Contacting us through the site

Please make sure what you send is accurate and that you're entitled to share it. How we use the information you give us is explained in our privacy policy.

Accuracy and availability

We try to keep the site accurate and available, but we don't promise it will always be error-free, up to date or uninterrupted. We may change or remove content, or take the site offline, at any time.

Our responsibility

Nothing in these terms limits liability that can't legally be limited, including for death or personal injury caused by negligence, or for fraud. Otherwise, the site is provided "as is" and, to the extent the law allows, we aren't liable for loss arising from your use of it or reliance on it, or for indirect or consequential loss. This doesn't affect any rights you have as a consumer, or the terms of any project agreement we make with you.

Links

The site may link to other websites. We don't control them and aren't responsible for their content. If you'd like to link to us, please link to the home page or a page you find useful, and don't suggest we endorse you without our agreement.

Changes to these terms

We may update these terms from time to time. The version on this page, with the date above, is the one that applies when you use the site.

Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction, unless your local consumer law gives you the right to bring a claim elsewhere in the UK.
